Hypergate.ai Terms of Service

Effective Date: March 10th, 2025

1. Introduction

These Terms of Service (“Terms”) govern your use of Hypergate.ai and any related services provided by Narrative First, Inc. and 12th House Media, Inc. (“we,” “us,” or “our”). By accessing or using our app, platform, or services, you agree to be bound by these Terms.

2. Account Registration

To access Hypergate.ai, you must create an account. You agree to provide accurate, current, and complete information, and to keep it updated. We reserve the right to suspend or terminate your account if your information is found to be inaccurate or incomplete.

3. License to Use Hypergate.ai

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use Hypergate.ai for personal or commercial purposes, subject to these Terms.

4. Restrictions on Use

You agree not to:

Use Hypergate.ai to generate or share harmful, illegal, or misleading content
Reverse-engineer or attempt to access the source code
Lease, sublicense, or transfer your account
Tamper with copyright or trademark notices
Disrupt or harm the platform or other users
Use bots or scrapers without written permission
Impersonate others or misrepresent your identity
Use the platform for spam, fraud, or disinformation
Share your account login with others

5. Prohibited Content

You may not use Hypergate.ai to generate content that includes:

Hate speech or harassment
Glorification of violence
Content encouraging self-harm
Sexually explicit or adult material
Political campaigning
False or misleading claims
Malicious software or malware

Violations may result in immediate account termination without refund.

6. Use in Sensitive Fields

Hypergate.ai is not intended for high-risk or regulated environments. You agree not to use the platform for decisions involving:

Healthcare or mental health
Emergency services
Legal or financial advice
Human safety or financial risk

We disclaim all liability resulting from misuse in these areas.

7. Subscription and Refund Policy

When you purchase a subscription to Hypergate.ai—whether through the app, website, digital download, special event, or paid video content—no refunds are provided.

You may cancel your subscription at any time. Your access will remain active through the end of your current billing cycle.

To cancel your subscription:

Go to Be You → Subscription → Cancel Subscription
If canceled via support, access ends immediately
If canceled via account settings, access continues until the end of your billing cycle

By subscribing, you acknowledge:

No refunds will be issued for cancellations, unavailable features, or discontinued content
All content and features are subject to change or delay
No refunds, credits, or partial reimbursements will be issued under any circumstance

8. Intellectual Property

All platform content—including AI-generated responses, visuals, horoscopes, user interface elements, source code, and any proprietary tools—is the exclusive intellectual property of Narrative First, Inc. and 12th House Media, Inc. This includes all content provided through paid subscriptions and premium services.

You are granted a limited, non-exclusive, non-transferable license to access and use this content for personal, non-commercial purposes only, in accordance with these Terms. You may not reproduce, distribute, modify, or publicly display any platform content without written permission.

You retain ownership of any original content you submit or create within the platform (e.g., journal entries, uploaded materials), but by doing so, you grant us a perpetual, irrevocable, non-exclusive license to use, modify, and distribute that content for platform improvement and functionality—unless you mark it as private.

9. Data Usage & Privacy

9.1 AI Training

We do not use your personal data to train any third-party or external AI models. Select anonymized platform usage data may be used internally to enhance performance and improve your experience.

9.2 Privacy Controls

You may mark any sessions, notes, or uploaded materials as private. Private content will be excluded from internal optimization and platform improvement efforts.

9.3 Security

We implement industry-standard security measures to protect your information and maintain the integrity of our systems.

9.4 AI Output Disclaimer

All AI-generated content is provided for informational and entertainment purposes only. It does not constitute professional advice (legal, financial, medical, or mental health), and should not be relied upon as such.

9.5 Data Retention & Deletion

We store your account data securely to support your usage of the platform. You may request full deletion of your account and associated data at any time. Once deleted, this data is not recoverable.

9.6 Model Evolution

As part of ongoing platform development, our AI models and algorithms may be updated or replaced. This may result in different or evolving outputs over time. We do not guarantee consistency of AI-generated responses.

10. Third-Party Services Disclaimer

Hypergate.ai may rely on third-party providers (e.g., OpenAI). We are not responsible for interruptions caused by these services.

No refunds or liability will be provided for outages, delays, or failures caused by third parties.

11. Submitted Content

By submitting any materials to Hypergate.ai (text, notes, uploads, etc.), you grant us a perpetual, irrevocable license to use, copy, distribute, and modify such materials for platform enhancement. You confirm you hold rights to this content and it does not infringe on any third-party rights.

12. Disclaimers

Hypergate.ai is provided “as is” and “as available.” We do not guarantee uninterrupted use, accuracy, or error-free operation.

12.1 Third-Party Integrations

We may integrate with third-party services (e.g., payment processors, astrology databases). We are not responsible for their performance, security, or data use.

13. Limitation of Liability

We are not liable for indirect or consequential damages, including lost profits or data.

Our total liability is limited to the amount you paid in the past 12 months.

14. Indemnity

You agree to indemnify and hold harmless Narrative First, Inc., 12th House Media, Inc., and all affiliates from any claims arising from your use of the platform or violation of these Terms.

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated at least 30 days in advance. Continued use of Hypergate.ai after updates implies acceptance.

16. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in California courts.

17. Severability

If any portion of these Terms is deemed unenforceable, the remaining provisions will still apply in full force.

18. Entire Agreement

These Terms represent the entire agreement between you and Narrative First, Inc. and 12th House Media, Inc., superseding any prior agreements.
